1. About Givvio

Givvio is a fundraising platform that gamifies charitable giving through interactive games like trivia, word games, and other casual games. Organizations can create fundraisers with embedded games to engage donors and track progress through leaderboards.

2. Acceptance of Terms

By creating an account, accessing, or using Givvio, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference and forms part of this agreement.

3. Eligibility

3.1. You must be at least 18 years old to use Givvio, or have consent from a parent or guardian if you are a minor.

3.2. You represent that you have the legal authority to enter into these Terms on behalf of yourself or any organization you represent.

3.3. You may not use our service if you have been previously banned or if your account has been terminated.

4. Account Registration and Security

4.1. You must create an account to access and use Givvio's features.

4.2. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4.3. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4.4. You must immediately notify us of any unauthorized use of your account or any security breach.

4.5. We reserve the right to refuse registration or cancel accounts at our discretion.

5. Permitted Use and Restrictions

5.1. Permitted Use: You may use Givvio solely for lawful fundraising activities and charitable purposes.

5.2. Prohibited Activities: You agree not to:

6.3. You grant Givvio a non-exclusive, royalty-free license to use, display, and distribute your content in connection with operating the platform.

6.4. We reserve the right to remove or refuse to display any content that violates these Terms or is otherwise objectionable.

6.5. You must comply with all applicable laws regarding charitable fundraising in your jurisdiction.

7. Donations and Fees

7.1. All donations made through Givvio are voluntary and final.

7.2. Refund Policy: Donations are generally non-refundable. However, in cases of fraud, error, or other exceptional circumstances, refunds may be considered at Givvio's sole discretion.

7.3. Our Fees: Givvio may deduct processing and platform fees on total donations for fundraising events. Please see your fundraiser organizer for the fee schedule.

7.4. Tax Responsibility: You are responsible for any tax obligations related to funds raised through the platform.

7.5. Donors are responsible for determining the tax deductibility of their contributions.

8. Privacy and Data Protection

8.1. Your privacy is important to us. Our collection, use, storage, and sharing of your personal information is governed by our Privacy Policy.

8.2. By using Givvio, you consent to the collection and use of your information as described in our Privacy Policy.

8.3. You are responsible for ensuring that any personal information you provide about donors, beneficiaries, or others is collected and shared in compliance with applicable privacy laws.

11. Disclaimers and Limitation of Liability

11.3. Limitation of Liability: To the maximum extent permitted by law, Givvio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the platform.

11.4. Damage Cap: Our total liability to you for all claims shall not exceed the fees you paid to Givvio in the 12 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Givvio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms.

13. Account Termination

13.1. You may terminate your account at any time by contacting our support team.

13.2. We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or harmful activities.

13.3. Upon termination, your right to use the platform ceases, but these Terms remain in effect regarding past use.
